Withholding of Removal

Withholding of removal is an immigration benefit that is granted to individuals who face the prospect of being tortured in their home country but who do not qualify for political asylum. If you are granted withholding of removal by an immigration judge you will be permitted to live and work in the United States. However, your subsequent departure and reentry into the United States will not be permitted because Individuals who have been granted withholding of removal have an outstanding order of removal that has been suspended by an immigration judge. Furthermore, withholding of removal does not provide the recipient with a path to citizenship because the suspended order of removal acts as a legal impediment to any efforts by the recipient to adjust his/her immigration status to that of lawful permanent resident.

Individuals who apply for withholding of removal must demonstrate to an immigration judge that they were tortured in the past or that it is more likely than not that they will be tortured in the future if they return to their home country. The applicant must also show that any past torture was inflicted (or that the prospect of future torture is more likely than not to be inflicted) by the government, government agents, or by individuals or by a group that the government is unable or unwilling to control. It is essential that an individual who seeks withholding of removal provide the immigration judge with credible testimony and sufficient documentation to support his/her claim of past torture or of the likelihood of future torture.
