Immigration Bond Hearings

Deportation Defense Attorney in Annandale, Northern Virginia

If you have been detained by U.S. Immigration Customs Enforcement ("ICE") it is crucial that you contact The Law Offices of Miguel Rivera to secure your legal rights. Retaining the services of our law firm at the earliest possible time is vital in order to secure your release from ICE custody. Once you have retained us, we will quickly request an immigration bond on your behalf. If ICE determines that you are eligible to be released from custody, it will set the bond amount. However, if ICE declines the bond request or sets the bond amount too high, we will immediately seek a bond redetermination hearing before an immigration judge. The immigration judge will then decide whether to grant the bond or whether to lower the initial bond amount set by ICE. The immigration judge will base his decision on the following factors:

  1. A showing of significant family and/or economic ties in the United States demonstrating that you do not pose a flight risk and that you are likely to attend all future court hearings;
  2. A showing that you do not pose a danger to the community (No aggravated felony convictions or convictions for crimes of violence);
  3. A prima facie showing that you are eligible for relief from removal, such as, political asylum, withholding of removal, cancellation of removal, Temporary Protective Status, VAWA, NACARA, DACA, etc.

If you are currently in ICE custody or have a family member who is in custody, we encourage you to contact The Law Offices of Miguel Rivera to schedule a free legal consultation. Your decision to work with our firm will make all the difference in your case. We have helped thousands of individuals with their immigration problems and we may be able to help you as well.
